Terms of Service — BuildFlow IQ

1. Agreement to Terms

By accessing or using BuildFlow IQ ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Platform.

2. Description of Service

BuildFlow IQ provides an AI-powered construction estimation platform that includes:

AI-powered cost estimation and BOQ management
Supplier sourcing and RFQ management
Project and estimate tracking
Document analysis and storage
Real-time market price data for UK construction materials

3. User Accounts

To use our Platform, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use
Be at least 18 years old or have parental consent

            
            Account Security: You are responsible for all activity on your account. Use a strong, unique password and enable two-factor authentication.
        

4. Subscription and Payment

BuildFlow IQ offers subscription-based pricing plans:

Starter Plan: £49/month - Up to 5 active projects
Professional Plan: £99/month - Unlimited projects and advanced features
Enterprise Plan: Custom pricing - Tailored solutions for large organizations

All subscriptions include a 14-day free trial. Payments are processed securely via Stripe. Subscriptions auto-renew monthly unless cancelled. You may cancel anytime from your account settings.

5. Free Trial

New users receive a 14-day free trial. After the trial period, you will be automatically billed at your selected plan's rate unless you cancel before the trial ends. No credit card is required to start the trial.

6. User Responsibilities and Prohibited Uses

You agree to use BuildFlow IQ only for lawful purposes. You may not:

Use the Platform for any illegal activity or violate any laws
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems
Reverse engineer, copy, or resell our platform without permission
Use the Platform to harass, abuse, or harm others
Interfere with or disrupt the Platform's operation

7. Intellectual Property

BuildFlow IQ and its original content, features, and functionality are owned by BuildFlow IQ Ltd and are protected by UK and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any data, estimates, documents, and other content you upload to the Platform ("Your Content"). By uploading, you grant us a license to host, store, and process Your Content to provide our services.

8. AI Features Disclaimer

Our AI-powered features provide suggestions and automated analysis, but they are not a substitute for professional judgment. You are responsible for:

Reviewing and validating all AI-generated estimates and recommendations
Verifying market prices and supplier information
Making final business decisions based on your professional expertise

BuildFlow IQ is not liable for any decisions made based on AI-generated outputs.

9. Third-Party Integrations

Our Platform may integrate with third-party services (payment processors, document viewers, etc.). We are not responsible for the practices or content of these third parties.

10. Data Privacy

Your use of BuildFlow IQ is also governed by our Privacy Policy. By using the Platform, you consent to our data practices as described in the Privacy Policy.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users. You may delete your account at any time from account settings. Upon termination, your right to use the Platform will cease immediately.

12. Limitation of Liability

To the maximum extent permitted by law, BuildFlow IQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Platform.

            
            Total Liability: Our total liability to you shall not exceed the amount paid by you, if any, for accessing the Platform during the 12 months preceding the claim.
        

13. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the courts of London, United Kingdom.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
